Henry County Probate Court

Vital Records

Beginning Monday, May 6, 2013, customers who visit the Probate Court will have the option of scheduling an appointment for the following services:

  • MARRIAGE LICENSES
  • WEAPONS CARRY PERMITS
  • PATERNITY ACKNOWLEDGEMENTS
  • HOME BIRTH REGISTRATIONS
  • AMENDMENTS TO A BIRTH CERTIFICATE OR BIRTH RECORD
  • DELAYED BIRTH RECORDS
  • PETITION FOR TEMPORARY GUARDIANSHIP OF A MINOR CHILD
  • PETITION TO TERMINATE TEMPORARY GUARDIANSHIP OF A MINOR CHILD
  • PETITION FOR COMPROMISED CLAIM OR CONSERVATORSHIP OF A MINOR CHILD
  • PETITION FOR GUARDIANSHIP OR CONSERVATORSHIP OF AN ADULT
  • PETITION FOR PROBATE, ADMINISTRATION OR YEAR’S SUPPORT
  • FILE ANNUAL REPORTS - INVENTORIES, ANNUAL RETURNS OR PERSONAL STATUS REPORTS – Unless you have questions, it is not necessary to see a clerk in order to file your annual report.  These documents, along with the appropriate filing fee, may be submitted to the receptionist in person or submitted by mail.  Please click on the Fee Schedule (to the left of the page) for applicable filing fees, if any.  If you wish to speak with a clerk, please schedule an appointment.

Those who wish to make an appointment will need to visit our office between 8:00 a.m. – 4:30  p.m., Monday-Friday, to schedule their appointment time.  Please note that due to the high volume of walk-in customers, those who wish to apply, or file for any of the above without an appointment may experience long wait times.  

It is NOT necessary to make an appointment for any of the following:

Copy of Birth or Death Records
Filing of Death Certificates
Copy of Marriage Record
Certificate of Residency
Order to Apprehend for Evaluation (also known as two party affidavit)
Emergency Adult Guardianship
Oaths
Firework Permits
Veterans License

For ALL customers who will be filing a Petition or Annual Report – Please make sure that you print and fill out your petition or report before arriving for your scheduled appointment time.  If your petition or report is incomplete, it may be necessary for you to schedule an additional appointment at a later date. 

**With the help of the Henry County Technology Services Department and programming staff, we will be able to offer the ability to make appointments online in the near future.

To obtain a certified copy of a birth, death or marriage certificate, customers are welcome to visit our office, mail in a request or place an order online. Most requests can be processed while you wait, however, the wait time depends on the volume of customers who have already signed in.

If you choose to visit our office in person, please complete the request form and bring it with you. Directions for mail in and online orders will be given below. Cash, Money Orders, local Henry County checks, MasterCard and Visa debit/credit cards are accepted. Credit/Debit cards are only accepted in person – No credit/debit card payments will be accepted by phone or mail.

Birth Certificate

  • Valid ID must be presented in order to obtain a birth certificate
  • The fee for the first certified copy is $25.00.  ($5.00 for each additional copy ordered for the same person at the same time)
  • Note – In order to obtain a Birth Certificate, you must be a parent, grandparent, spouse, adult brother or sister, legal guardian, child legal representative or self.

Amended or Delayed Birth Certificates

In order to file for a delayed birth certificate or to amend your current birth certificate (adults only) you must have three of the following documents.  Each document must be certified and they should all have the same spelling of your name and the same birth date.

All of the documents should be at least 10 years old and one of the documents should also include your father’s full name and your mother’s full maiden name. 

For females all of the documents must include your maiden name.

The following are suggested examples of the types of documents needed and should not be construed as a complete list:

  • Your child’s birth certificate with your name and age or birthday
  • Marriage License Application
  • School Records
  • Hospital Records
  • Voter’s Registration Application
  • Employment Records
  • Military Records

Once the documents have been compiled, please bring them into the Probate Court office.  We will prepare the necessary petition to be filed with Georgia State Vital Records.  The timeframe is usually 6-8 weeks for State Vital Records to prepare the Delayed Birth Certificate or the Amended Certificate.

Death Certificate

  • Valid ID must be presented in order to obtain a death certificate.
  • The fee for the first certified copy is $25.00.  ($5.00 for each additional copy ordered for the same person at the same time)
  • Note – In order to obtain a Death Certificate, you must be a parent, legal living spouse, adult child, adult sibling, next of kin, legal guardian or legal representative.  Proper documentation will be required.
  • Please call our office at 770-288-7600 with any questions you may have.

Marriage Certificate

  • Anyone may request a marriage certificate.
  • Fee - $10.00 for each certified copy. 

To mail in a request for a BIRTH or DEATH certificate, you will need to send the following:

  • Photocopy of your valid driver’s license or state issued I.D.
  • Completed request form
  • Payment - Money Order only
  • Self addressed stamped envelope

To mail in a request for a MARRIAGE certificate, you will need to send the following:

  • Completed request form
  • Payment - Money Order only
  • Self addressed stamped envelope
