The property consists of 93.10 +/- acres, and the request is for an appeal to a decision regarding a final plat for the Kimbell Farms, Unit VI subdivision. A.   Hayes Development RZ-02-73; Commissioner Harper, District 3 (Exhibit #7)

Hayes Development of Fayetteville, GA requests a rezoning from RA (Residential Agricultural) to R-2 (Single-Family Residence) for property located on the south side of Campground Road, just east of South Salem Drive, in Land Lot 60 of the 7th District. The property consists of 50.41+/- acres, and the request is for a single-family residential subdivision. The Board of Commissioners will consider a Consent Order which will require the re-zoning of the property; if such Consent Order is approved, the Board of Commissioners will rezone the property in accordance with the Consent Order, or as is otherwise approved by the Board of Commissioners. G&G Land Development, LLC of Stockbridge, GA requests a modification to a zoning condition for property located on the south side of Walnut Creek at Elliott Road (Gardens Gate Subdivision), in Land Lot 73 of the 7th District. The property consists of 48.32 +/- acres, and the request is to modify a condition pertaining to garages. District 3 Municipal Planning Commission recommended Approval at the August 12, 2004 meeting. The property consists of 62.0 +/- acres, and the request is for a single-family residential subdivision. District 3 Municipal Planning Commission recommended Denial at the February 26, 2004 meeting.
